Waiver and Release Liability

I/We hereby understand and acknowledge that the training, programs, classes, and events held by LHNY Tennis LLC may expose me or my child to many inherent risks, including accidents, injury, illness or even death. I/We assume all risk of injuries for me or my child associated with participation in LHNY Tennis LLC activities including, but not limited to, falls, contacts with other participants, equipment or tennis balls, and all other such risks being known and appreciated by me.

I/We accept full responsibility for the use of any and all equipment, facility privilege or service whatsoever, owned and operated by this club at my/our own risk and shall not hold LHNY Tennis LLC, its shareholders, officers, employees, representatives, and agents liable for any and all loss, claim, injury or liability sustained or incurred during voluntary participation at LHNY Tennis LLC and their programs.

I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with my participation or the participation of my child in any activity. I/We acknowledge that I/We or my child are physically fit and mentally capable of performing the physical activity I/We choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and/or the participation of my child in the services provided to me/my child by LHNY Tennis LLC, I agree, for myself, and anyone acting on my behalf, to HOLD HARMLESS, WAIVE, and RELEASE LHNY Tennis LLC, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands of every kind, losses, injuries, property damage or claims or any kind arising out of my participation and/or the participation of my child in LHNY Tennis LLC activities or events; or arising out of the use or intended use of any facilities, equipment or other property of LHNY Tennis LLC; and I/We covenant not to sue therefore.

I hereby attest and verify that I have full knowledge of the risks involved in LHNY Tennis LLC activities, that I assume those risks, that I will assume and pay my own medical expenses and emergency expenses in the event of accident, illness or other incapacity, regardless of whether I have authorized such expense.

I further agree to provide any appropriate medical information to LHNY Tennis LLC if I am required to by LHNY Tennis LLC. In addition, in case of accident or injury to me and/or my child and if an emergency contact person cannot be reached, I grant LHNY Tennis LLC permission to obtain medical attention if necessary, for which I will be financially responsible.

I understand and agree that LHNY Tennis LLC is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

COVID - 19 Waiver and Release

Using the measures and guidelines provided by the State of New York, the US Tennis Association, I understand that LHNY Tennis LLC has put in place enhanced health and safety measures to reduce the spread of COVID-19, I also understand that LHNY Tennis LLC cannot guarantee that I or my child(ren) will not become infected with COVID-19.

By signing this agreement and visiting and using the facilities of LHNY Tennis LLC, I acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending LHNY Tennis LLC and that such exposure or infection may result in extreme illness, permanent disability, and possibly death.

I understand that the risk of becoming exposed to or infected by COVID-19 at LHNY Tennis LLC may result from the actions, omissions, or negligence of myself and others, including but not limited to LHNY Tennis LLC employees, volunteers and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, to my child(ren) or myself (including but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at LHNY Tennis LLC or participation in LHNY Tennis LLC programming (“Claims”).

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless LHNY Tennis LLC, its employees, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LHNY Tennis LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LHNY Tennis LLC program.

I/We indicate that I/We have read and understand this Waiver of Liability and Waiver and Release of COVID - 19. I know this is a waiver and a release of liability, and I voluntarily agree to its terms.

We reserve the right to reasonably utilize photos or videos taken at LHNY Tennis LLC that may include you as promotional material for social media or others. I/We indicate that I/We have read and understood this Media Release. I know this is a release of liability, and I voluntarily agree to its terms.

All clients or guests of LHNY Tennis must adhere to our website's club policies.
